The following is a SAMPLE agreement for purchasing a puppy.
Each contract will be similar to this. There will be some customization for each owner, and these
will be agreed upon by both parties.

pet/companion puppy is defined here to be a Smooth Fox Terrier puppy which is sound and in good health at the time of sale, and embodies the characteristics of the Smooth Fox Terrier breed. This puppy is purebred and will be limited registered with the American Kennel Club. Limited registration does not allow the registering of offspring. The BUYER would agree to this PUPPY being spayed or neutered at the appropriate age (at least 6 mo of age), and veterinarian confirmation of this procedure must be supplied to the BREEDER.The
pet puppy is not to be used for breeding purposes.A
show puppy is defined here to be a Smooth Fox Terrier puppy which is sound and in good health at the time of sale and be of breeding quality. This puppy meets all the qualifications to be reasonably competitive in AKC licensed shows and trials, but is not a guarantee to become an AKC Champion of Record. This puppy does not have any disqualifications set forth by the AKC breed standard. If show PUPPY/DOG develops any genetic condition which will deem it unfit for breeding/showing in the United States, before the age of 3 years, or if show PUPPY/DOG does not meet qualifications to finish an AKC Championship; the PUPPY/DOG must be returned to BREEDER at BUYERS expense and will be replaced with the next available replacement of equal or better value. In the event that the BUYER wishes to retain possession of said animal; it will have to be spayed or neutered before the replacement is received. This must be verified by a veterinarian. A replacement puppy may or not be out of the same or a similar breeding, depending on the what is available in the BREEDER’S kennel at that time. There will be NO cash refunds.The

This PUPPY is considered a (

The parents of this PUPPY have had the health tests, BAER tested normal, CERF clear and Thyroid tested normal.
The BREEDER guarantees the above described PUPPY to be healthy at the time of the sale.
The BREEDER does not assume any liability for any injury to said PUPPY after delivery.
The BREEDER recommends that the BUYER have this PUPPY examined by a veterinarian within 72 hours of delivery, at the BUYER’S expense.
If the PUPPY is found to be other than healthy by the BUYER’S veterinarian, it shall be returned to the BREEDER immediately, along with the PUPPY’S registration papers, and the purchase price will be refunded. Deadline for this refund is ten (10) days. BREEDER to pay shipping costs.
All appropriate shots for the PUPPY’S age have been given, and a record of this vaccination history is supplied.
The BUYER agrees to provide a suitable fenced area for this PUPPY. It shall not be allowed to run at large.
The BUYER agrees to maintain the PUPPY’S health in good condition, and to provide yearly examinations, vaccinations, (heartworm test if outside Alaska), maintain a suitably clean and healthy environment, proper socialization and exercise, and any other usual procedures necessary to assure good health.
The BREEDER has done everything possible to produce healthy sound puppies both by breeding only dogs (parents) that are BAER and CERF tested, Thyroid checked and by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary care.
The BUYER agrees to have the PUPPY BAER tested for OFA Patella Luxation, normal hearing, CERF testing with negative PRA results, and Thyroid testing of normal results before any breeding is completed.

The BUYER agrees that in the event that this DOG is a bitch, it must comply with proper genetic testing before breeding and that the stud dog used will also have all genetic tests completed. Genetic testing includes OFA (Lux Patella), CERF, BAER, and Thyroid. _____________ (please initial)

The BUYER hereby agrees that if at any time the BUYER cannot take proper care of the PUPPY, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back (at BUYER’S expense) or (b) assist the BUYER in finding a suitable home for the PUPPY. At

The BUYER agrees to notify the BREEDER of any changes of address during the PUPPY’S lifetime.
The BUYER releases the BREEDER and the BREEDER’S estate from any and all liabilities and/or damages by fault of this PUPPY after the time of delivery/sale. These damages include, but are not limited to, destruction of property and/or physical damage to any person or group of people.
The BUYER certifies that he/she is not acting as an agent for another individual in the purchase of this PUPPY, and will not sell this PUPPY to any mass-producing kennel (puppy mill) or business, nor to any entity that might use this PUPPY in any experiments, laboratory or otherwise.
The BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the BREEDER and BUYER with respect to this sale. The BUYER’S signature below indicates that he/she has read, agrees and does understand all the conditions of the Sales Agreement and Contract of Sale.
IN THE EVENT THE BUYER FAILS TO PERFORM ANY PROVISION OF THIS AGREEMENT INCLUDING THOSE ACTS WHICH HE/SHE HAS WARRENTED AND GUARANTEED TO PERFORM, THEN AND IN SUCH EVENT THE SELLER MAY, AT HER OPTION, REVOKE THIS AGREEMENT OF SALE AND RETAKE POSSESSION OF THIS DOG WITH BUYER FORFEITING ALL FURTHER RIGHTS TO THE DOG AND THE CASH CONSIDERATION PAID TO THE SELLER AS LIQUIDATED DAMAGES FOR THE BREACH OF THIS AGREEMENT AND OF THE WARRENTY AND GUARANTY. ANY SUCH AKC REGISTRATION PAPERS SHALL ALSO BE PROMPTLY SIGNED AND RETURNED TO BREEDER.
